What’s the harm in having high-rises/hotels on the Atlantic Beach oceanfront?

Potential problems:

  • Hundreds of condo residents will have more voting power than all the other residents combined, collectively they’d have the ability to repeal the town’s charter—making us a neighborhood in North Myrtle Beach instead of the historic last Black beach town in the United States.
  • Traffic congestion.
  • Environmental issues.
  • Strain on the infrastructure.
Who enforces deed restrictions on land?

Any individual property owner can sue for enforcement. All property owners “have standing”.

What does run with the land mean?

Runs with a land is a restriction/covenant that transfers when ownership of the
land transfers. The future owner of the property, subject to a covenant that runs
with the land, is bound by that covenant.

Do deed restrictions run with the land?

Deed Restrictions usually run with the land, which means they bind anyone who
becomes the legal owner.

Do deed restrictions supersede zoning?

In most places in the United States deed restrictions outweigh local, county, and state zoning when the deed restrictions are more strict.

Who is handling and overseeing STARD’s administrative, operational, fundraising and legal aspects?

A volunteer board made up of a diverse group of residents and property owners.

Is there shared governance and extreme transparency?

Yes, there is shared governance and transparency among the board members. To date the decision was overwhelmingly in favor of advancing a court action for enforcement of the deed restrictions. Donations from supporters and property owners fund the legal and program fees. All information is shared.

Is (501c-3) formed with an executive team of property owners responsible for the operational aspects?

Yes. As of February 2023 STARD was formed with an executive team of property owners responsible for the operational aspects, and in May 2023 received its tax-deductible status.

Will a high-rise along the oceanfront require the opening of Ocean Boulevard?

A major concern is that a high-rise and the density of the population resulting from it will result in an effort from the surrounding communities to open the road. People stroll, bike and walk along Ocean Boulevard taking in views of the Atlantic Ocean and the new beach homes that line the street in Atlantic Beach. The north and south borders of Ocean Boulevard have been blocked since the town was segregated by the political leaders of North Myrtle Beach during the Jim Crow era. What was intended to ostracize the area backfired and created a private, semi-secluded oasis. The road closure creates what feels like a private subdivision and gated community. Unlike the rest of the Grand Strand, no traffic speeds through the four streets that make up Atlantic Beach.
